ShoreList LLC (“ShoreList,” “we,” “us,” or “our”) operates the website located at shorelist.net (the “Site”). This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you visit or use our Site.
By using the Site, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree, please do not use the Site.

ShoreList LLC is a North Carolina limited liability company headquartered in Wilmington, NC. We operate an online marketplace connecting visitors with local experience operators — tours, surf lessons, fishing charters, nature walks, and more — in the Wilmington, NC coastal region.

Information We Collect Automatically
When you visit the Site, we automatically receive certain technical information including your IP address, browser type, device type, operating system, referring URL, pages visited, and time spent on the Site. This information helps us understand how the Site is used and improve the experience.
Information We Do Not Collect
We do not collect or knowingly retain sensitive personal data including Social Security numbers (except Tax ID from operators for IRS reporting), government-issued ID numbers, health information, or biometric data. We do not collect information from children under 13.
How We Use Your Data
We use the information we collect for the following purposes:
- To process and confirm bookings — your name, email, phone, and booking details are shared with the operator you book with
- To process payments — payment data is sent to Stripe for processing. ShoreList does not store payment card data on our servers
- To send booking confirmations and receipts — via email immediately after checkout
- To send launch notifications — if you joined our waitlist, we will email you when bookings go live. You can unsubscribe at any time
- To improve the platform — aggregate, anonymized usage data helps us understand what works and what doesn't
- To prevent fraud and maintain security
- To comply with legal obligations — including tax reporting, dispute resolution, and law enforcement requests where required
We do not sell your personal data. We do not rent, trade, or sell your personal information to third-party marketers, data brokers, or advertisers — ever.
Payments & Stripe
All payment processing on ShoreList is handled by Stripe, Inc., a PCI-DSS Level 1 certified third-party payment processor. When you enter payment information at checkout, that information is transmitted directly to Stripe using encrypted connections (TLS/SSL). ShoreList never sees, receives, or stores your full credit card number, CVV, or payment account credentials.
Stripe processes your payment, charges the applicable amount, and remits the operator's portion to their account. Stripe retains transaction data in accordance with their own privacy policy, available at stripe.com/privacy.
Cancellations & Refunds
Guests who cancel at least 24 hours before their scheduled experience are entitled to a full refund processed through Stripe back to the original payment method. Refunds typically appear within 5–10 business days depending on your card issuer.

We do not share your data with social media platforms, advertisers, or data brokers. ShoreList does not run advertising and has no advertising partners.
Your Rights
Right to Access
You may request a copy of all personal data ShoreList holds about you. We will respond within 30 days.
Right to Correction
If any information we hold about you is inaccurate, you may request that we correct it.
Right to Deletion
You may request that we delete your personal data. We will do so promptly unless we are required to retain it for legal, tax, or fraud prevention purposes. To delete your data, email shorelistwilmington@gmail.com with the subject line “Data Deletion Request.”
Right to Opt Out of Marketing
Every email we send includes an unsubscribe link. You may also email us directly at any time to be removed from all communications. We will process opt-out requests within 10 business days.
California Residents — CCPA Rights
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information is collected, the right to opt out of the sale of personal information (note: we do not sell personal information), and the right to non-discrimination for exercising your privacy rights. Children's Privacy — COPPA Compliance
ShoreList does not knowingly collect personal information from children under the age of 13. The Site is not directed to children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us immediately and we will delete that information promptly.
Data Security
We take reasonable and appropriate measures to protect your personal information from unauthorized access, alteration, disclosure, or destruction. These measures include:
- SSL/TLS encryption on all pages of the Site (HTTPS enforced)
- Stripe's PCI-DSS Level 1 certified payment processing — we never handle raw payment card data
- Netlify's secure hosting infrastructure for platform reliability and security
- Limited data access — only authorized ShoreList personnel can access booking data
No method of transmission over the internet or electronic storage is 100% secure. In the event of a data breach that affects your personal information, we will notify you promptly in accordance with applicable law.
Data Retention
- Booking records — retained for 7 years for tax and accounting purposes in compliance with IRS requirements
- Waitlist email addresses — retained until the launch date and then either converted to active user accounts or deleted within 90 days unless you opt in to further communications
- Operator application data — retained for the duration of the operator relationship plus 3 years
- Web server logs — retained for 90 days then automatically purged
Cookies & Tracking
ShoreList uses a minimal cookie footprint. We do not use third-party advertising cookies, behavioral tracking pixels, or cross-site tracking technologies.
Cookies We Use
- Session cookies — to maintain your browsing session as you navigate the Site. These expire when you close your browser.
- Stripe cookies — set by Stripe during checkout for fraud prevention and security. Required for payment processing to function.
- Google Analytics — we use Google Analytics 4 to understand how visitors use the Site in aggregate. Google Analytics is configured to anonymize IP addresses. You may opt out of Google Analytics tracking using the Google Analytics Opt-out Browser Add-on.
Why We Do Not Display a Cookie Banner
The European Union's GDPR and the United Kingdom's PECR require explicit consent for non-essential cookies. ShoreList does not deploy non-essential cookies (no advertising trackers, no social media pixels, no cross-site tracking). Strictly necessary cookies (session, security) do not require consent under GDPR Article 5(3). Analytics cookies use anonymized IP addresses and aggregate reporting only, falling under our legitimate interest basis. We will introduce a cookie consent mechanism if our cookie usage materially expands in the future.
You may disable cookies in your browser settings, but doing so may affect the functionality of the checkout process.

These Terms of Service (“Terms”) govern your use of the ShoreList website and platform. By accessing or using ShoreList, you agree to be bound by these Terms. If you do not agree, do not use the platform.
The ShoreList Platform
ShoreList is an online marketplace that connects guests with local experience operators in the Wilmington, NC coastal region. ShoreList facilitates the discovery and booking of experiences but is not itself the operator of any experience. All experiences are conducted by independent third-party operators who are individually responsible for their services.
User Accounts & Eligibility
You must be at least 18 years old to make a booking on ShoreList. By using the platform, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If booking on behalf of a minor or other person, you represent that you have authority to bind them to these Terms.
Bookings & Payments
When you book an experience through ShoreList, you are entering into a direct agreement with the individual operator for that experience. ShoreList facilitates the transaction but is not a party to the service agreement between you and the operator. Full payment is required at the time of booking. All prices are in US dollars.
Cancellation & Refund Policy
Guests may cancel a booking and receive a full refund if cancellation is made at least 24 hours before the scheduled start time of the experience. Cancellations made less than 24 hours before the experience are non-refundable unless the operator agrees otherwise. In the event an operator cancels or materially changes a booked experience, guests are entitled to a full refund. To cancel a booking, contact ShoreList at shorelistwilmington@gmail.com with your booking confirmation number.
Operator Liability
Each experience operator is an independent contractor, not an employee or agent of ShoreList. ShoreList does not control or supervise how operators conduct their experiences. Operators are solely responsible for the safety, quality, and legality of their services. ShoreList is not liable for any injury, loss, damage, or dissatisfaction arising from an operator's experience.
User Conduct
You agree not to use the ShoreList platform to:
- Submit false, misleading, or fraudulent booking information
- Use the platform for any unlawful purpose
- Attempt to circumvent ShoreList's booking system by arranging direct payments with operators to avoid platform fees
- Harass, threaten, or harm ShoreList staff, operators, or other users
- Scrape, copy, or otherwise reproduce platform content without written permission
Intellectual Property
All content on the ShoreList platform — including but not limited to text, design, graphics, logos, and the “ShoreList” name and branding — is the property of ShoreList LLC and is protected by applicable intellectual property laws.
Disclaimer of Warranties
The ShoreList platform is provided “as is” and “as available” without warranties of any kind, express or implied. ShoreList does not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE NORTH CAROLINA AND FEDERAL LAW, SHORELIST LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY EXPERIENCE BOOKED THROUGH IT. SHORELIST'S TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE SPECIFIC BOOKING GIVING RISE TO THE CLAIM.
Indemnification
You agree to indemnify, defend, and hold harmless ShoreList LLC and its officers, members, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the platform shall be resolved in accordance with Section 13 (Arbitration) below, or in the state or federal courts located in New Hanover County, North Carolina where arbitration does not apply.
Changes to These Terms
ShoreList reserves the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page with a new effective date. Your continued use of the platform after any changes constitutes acceptance of the updated Terms.
For Operators
If you apply to list your business on ShoreList through the operator application at shorelist.net/join, you are subject to the ShoreList Operator Listing Agreement in addition to these Terms. Key points for operators:
- Your listing data — business name, description, pricing, photos, and availability are visible to the public on the ShoreList platform
- Guest data you receive — when a guest books your experience, you receive their name, email, phone, booking details, and special requests. You may use this information only to fulfill the booked experience and must not use it for unsolicited marketing
- Insurance requirement — as a condition of listing, operators must self-certify that they maintain commercial general liability insurance with minimum coverage of $1,000,000 per occurrence and $2,000,000 aggregate, and must provide a current Certificate of Insurance (COI) naming ShoreList LLC as an additional insured upon request. ShoreList reserves the right to suspend any listing pending COI verification.
- Removal — you may request removal of your listing and associated data at any time by contacting shorelistwilmington@gmail.com
Operator applications and listing agreements are governed by the ShoreList Operator Listing Agreement, a separate document provided during the onboarding process. The Operator Listing Agreement takes precedence over these Terms with respect to the operator relationship.
Assumption of Risk
Important: By booking any physical activity through ShoreList, you voluntarily assume all inherent risks. Please read this section carefully before booking.
Outdoor and physical activities — including but not limited to surfing, kayaking, fishing, nature walks, and cycling — involve inherent risks that cannot be eliminated regardless of the care taken by operators or ShoreList. These risks include, but are not limited to: drowning, collision, overexertion, exposure to weather, animal encounters, falls, equipment failure, and other hazards that may result in physical injury, illness, or death.
By completing a booking on ShoreList you acknowledge that:
- You have read and understood this assumption of risk
- You are voluntarily participating in the activity at your own risk
- You release ShoreList LLC and the individual operator from liability for injuries arising from participation, including those caused by ordinary negligence
- You are physically capable of participating in the activity you are booking
- You will comply with all safety instructions given by the operator
- If booking for a minor or other person, you have authority to bind them to these terms
Nothing in this section shall be construed to release any party from liability for gross negligence, willful misconduct, or intentional acts.
Arbitration & Class Action Waiver
Please read this section carefully. It affects your legal rights and contains a mandatory arbitration provision and class action waiver.
Mandatory Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms, the Privacy Policy, your use of ShoreList, or any experience booked through our platform shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in a court of law.
Exceptions to arbitration: you may assert claims in small claims court if your claims qualify; or either party may seek emergency injunctive relief in any court of competent jurisdiction to prevent irreparable harm pending arbitration.
The arbitration will be conducted in Wilmington, North Carolina, or by telephone or videoconference at your election. The arbitrator shall apply North Carolina law. Filing fees are governed by AAA rules. ShoreList will pay AAA fees for disputes under $10,000 where you are the claimant and the claim is not frivolous.
Class Action Waiver
YOU AND SHORELIST AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING.
Opt-Out Right
You may opt out of this arbitration agreement by notifying ShoreList in writing at shorelistwilmington@gmail.com within 60 days of the date you first use the ShoreList platform. Your opt-out notice must include your name, address, and a clear statement that you opt out of arbitration. Opting out of arbitration does not affect any other provision of these Terms.
Weather, Cancellations & Force Majeure
Force Majeure Events
Neither ShoreList nor any operator shall be liable for cancellations, delays, or failure to perform caused by circumstances beyond their reasonable control, including but not limited to:
- Hurricanes, tropical storms, tornadoes, flooding, lightning, or other severe weather events
- Acts of God or nature, including earthquakes, wildfires, or extreme weather
- Epidemic, pandemic, or public health emergencies declared by a government authority
- Government orders, mandatory evacuations, curfews, or beach closures
- Power outages or utility failures affecting the operator's ability to deliver the experience
Guest Refunds for Force Majeure
If a booked experience is cancelled due to a Force Majeure Event, guests will receive a full refund of all amounts paid. Refunds will be processed through Stripe within 5–10 business days.
Operator-Initiated Cancellations
If an operator cancels a confirmed booking for reasons other than Force Majeure, the guest will receive a full refund. Operators who cancel confirmed bookings without cause may be subject to suspension or removal from the ShoreList platform at ShoreList's sole discretion.
Weather Policy for Outdoor Activities
For outdoor activities affected by weather short of a Force Majeure Event, the cancellation decision rests with the operator based on their professional judgment and safety standards. Guests who are concerned about weather should contact ShoreList at shorelistwilmington@gmail.com at least 24 hours before their scheduled experience.
Tax Reporting & 1099-K
This section applies to operators who receive payments through the ShoreList platform.
IRS Form 1099-K
ShoreList LLC is a third-party payment settlement entity under IRS regulations. As required by federal law, ShoreList will issue IRS Form 1099-K to any operator whose gross payments processed through ShoreList meet or exceed the applicable reporting threshold in any calendar year. Operators should consult a tax professional regarding their specific obligations.
W-9 Requirement
Before ShoreList processes any payout to an operator, the operator must provide a completed IRS Form W-9 (or W-8BEN for non-US persons), including their legal name, business name (if applicable), address, and taxpayer identification number (EIN or SSN). Failure to provide a valid W-9 may result in ShoreList withholding 24% backup withholding from operator payouts as required by IRS regulations.
Operator Tax Responsibilities
Operators are solely responsible for reporting their ShoreList income on their own federal and state tax returns. ShoreList does not provide tax advice. ShoreList recommends that all operators consult a qualified tax professional.
For operators: Your EIN or SSN provided during signup is used solely for IRS tax reporting purposes. It is stored securely and never displayed publicly on the ShoreList platform.
AI Trip Planner Disclaimer
The ShoreList AI Trip Planner located at shorelist.net/planner generates suggested coastal itineraries based on your inputs using an automated large language model.
AI Output Is Not a Guarantee
Itineraries produced by the AI Trip Planner are suggestions only. They are not guarantees of:
- Operator availability on the dates suggested
- Pricing accuracy — prices may have changed since the AI was last updated
- Weather, surf, or water conditions
- Operating hours, seasonal closures, or schedule changes
- Operator quality, suitability, or safety for your specific group or needs
Verify Before You Travel
Always verify availability, pricing, weather conditions, and operating status with each operator before traveling. Use the AI Trip Planner as a starting point, not a final source of truth.
Limitation of Liability for AI Output
ShoreList is not liable for AI-generated suggestions that prove inaccurate, unavailable, outdated, or unsuitable for your circumstances. By using the AI Trip Planner you acknowledge that AI output may contain errors and you will exercise your own judgment when making travel decisions. The limitation of liability provisions in Section 10 apply in full to AI Trip Planner output.
